Who Can Enter
1. Entrants must be legal residents of Michigan who are 18 years of age or older and have lawful access to the Internet with a valid e-mail address.
2. Employees of Fox Television Stations, Inc., Palace Entertainment (collectively "Sponsor"), and their affiliates, and the advertising and promotion agencies of each, and the immediate family members of such employees, are ineligible.
How To Enter
1. No purchase is necessary to enter or win. Only one entry per band and no person may perform in more than 2 band entries. The contest begins when posted on July 29, 2008, and all entries must be received by 11:59 p.m. local time on August 14, 2008.
2. To enter, access the on-line contest entry form at www.MyFOXDetroit.com and follow all instructions to complete the on-line contest entry form. You must also upload a jpeg photo of your band and a 4 minute or less MP3 audio file of your band performing an original song. A band may consist of 1 person or a group of any number. By entering the FOX Rocks contest you represent and warrant that 1) all songs you submit and/or perform are original compositions written by 1 or more members of your band, 2) all authors of the song(s) have given their consent to the posting and/or performance of the song, and 3) all members of your band are 18 years of age or older and have consented to having their picture posted in connection with this contest. All songs must conform to MyFoxDetroit.com's then-current standards and practices and policies as established or determined by WJBK in its sole discretion. Without limiting the foregoing, songs may not contain profanity, references to violence, or demean any gender, race, religion or sexual orientation. Entry only becomes official after entrant has received a confirmation e-mail from FOX 2. Entrants must own the copyright to, or otherwise have all necessary rights in, all entry materials. Entry constitutes an unlimited perpetual license to Sponsor to use entry materials, including, but not limited to, the right to copy, distribute, publicly perform and display the entry materials on its websites, television stations and in any and all media whether now known or hereinafter invented.
Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winner(s) or other contest information by Sponsor or entrants for any reason whatsoever. Sponsor is also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the contest or for entries that are late, misdirected or incomplete. All entries become the property of Sponsor and will not be returned. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to cancel or revise the contest if it becomes technically corrupted.
3. SELECTION OF FOUR FINALISTS: All eligible contest submissions will be posted online at www.MyFOXDetroit.com. Four finalists will be determined by internet voting in accordance with voting rules announced at the time votes are solicited. The voting will begin when posted on August 16, 2008, and will continue through 11:59 p.m. local time on September 9, 2008. The four contestants with the most votes will be the finalists. Sponsor reserves the right to cancel the voting, or, at its option, to select the finalist by alternate means if, in Sponsor’s discretion, the voting becomes technically or otherwise corrupted. All members of the finalist bands may be required to sign a License and/or Release on or before September 11, 2008.
4. SELECTION OF THE WINNING BAND: The four finalists will perform at a designated time on Sunday, September 14, 2008, at the Metro Music Expo located at the Rock Financial Showplace. Inability to perform on September 14, 2008 at the Metro Music Expo or failure to timely return the Release will result in disqualification of the finalist and if time permits (in Sponsor’s discretion), the band with the next highest number of votes will get the opportunity to perform. Performances will be streamed LIVE on MyFOXDetroit.com and simultaneously recorded. Each band will perform for 15 - 20 minutes at the Metro Music Expo. The last song (must be an original composition as detailed in Rule # 2 under How to Enter and be no longer than 4 minutes in length) from that performance will be uploaded on MyFOXDetroit.com. This performance will be posted online at www.MyFOXDetroit.com and users will have the opportunity to vote for the contest finalist. The voting will begin when posted on September 15, 2008, and continue through 11:59 p.m. local time on September 18, 2008. The band with the most votes will be the winner. In the event of a tie the winning band will be selected by random drawing from the top two vote getting bands.
The Prize
1. The winning band will receive (a) the opportunity to perform on FOX 2 News Weekend on a mutually agreed upon date, on or before November 2, 2008 (b) the opportunity to perform for up to 15 minutes as the opening band for the Lynyrd Skynyrd Concert on September 21, 2008, at the DTE Energy Theatre, and (c) 20 tickets to the Lynyrd Skynyrd concert. The winning band must adhere to all rules from Palace Entertainment regarding selection of music for performance and may be required to sign additional documents. The approximate retail value of the prize is $300. In the event the concert for which the winner is schedule to perform is cancelled or postponed, the performance portion of the prizing may be cancelled without substitution or compensation therefore. Other restrictions may apply.
2. The winning band's representative member will be notified by phone. All members of the winning band will be required to sign and return an Affidavit and Release within 2 days of the date of notification or the entire band will be disqualified. If the band’s representative cannot be reached, the prize will be awarded to the band that received the second highest number of votes.
3. Except where prohibited by law, entry constitutes permission to use finalists' names, hometowns, likenesses, and photographs for online posting, and/or any advertising and publicity without additional compensation.
4. Prizes cannot be redeemed for cash or substituted for any other items by the finalists. The finalists cannot assign or transfer prize. Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason.
5. Each band must appoint one representative who must agree to be responsible for all local, county, state, and federal taxes on prizes based on the value of the prizes set forth in these rules.
Miscellaneous
1. Odds of winning depend on the number of bands entered and the number of votes received.
2. Complete contest rules are available Monday through Friday during normal business hours at WJBK-FOX 2, 16550 W. 9 Mile, Southfield, MI 48075 through September 18, 2008, and at www.MyFOXDetroit.com.
3. For the name of the winning band, send a separate, self-addressed, stamped envelope after September 18, 2008 to: FOX Rocks Winner c/o Box 2, Southfield, MI 48037-0002.
4. This contest is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules. Sponsor is not responsible for typographical or other errors in the printing, offering, or administration of the contest, or in the announcement of the prize.
5. Sponsor reserves the right to remove and/or disqualify any entry based on a claim of infringement.
6. By entering, participants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, (b) to release Sponsor, its parent, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, and (c) to Sponsor’s use of entrants’ personal information as described in Sponsor’s Privacy Policy located at www.MyFOXDetroit.com.
